Terms and Policies
SNAP Fitness Lakeside memberships are only valid and active if the required Membership Forms are signed. You can sign and view these documents by using the SNAP Fitness App. NOTE: Entering the facility without a valid membership or guest wavier form is trespassing.
By enrolling in a SNAP Fitness membership, you [member] acknowledge and agree to the club policies outlined below:
-- CLUB USAGE POLICY --
ASSUMPTION OF RISK OF INJURY AND WAIVER OF CLAIMS
I acknowledge that Snap Fitness® locations are unsupervised fitness centers. I acknowledge there is possible danger connected with any physical activity, including the dangers of physical injury and death. I assume all risks of injury, and waive all rights to pursue money damages or any other relief of any kind, arising out of (1) my entry into or upon any Snap Fitness® location; or (2) my use of any equipment, machinery, or facilities in any Snap Fitness® location or Snap Fitness® sponsored event. The Club and SNAP Fitness Duluth are in no way responsible for the actions of others, members or non-members, in or around the club premises. On behalf of myself and my successors and assigns, I agree to indemnify and will hold harmless Snap Fitness, Inc., its franchisees, and all of their owners, employees, agents, successors and assigns from and against any loss or damage that may be sustained by me or any person entering the Snap Fitness® club as my guest.
MINOR MEMBERS (if applicable)
PARENT/GUARDIAN. In exchange for Club allowing my minor child to use the Club, I agree to the Assumption of Risk of Injury and Waiver of Claims clause in this Agreement on their behalf. I also agree to defend and indemnify Snap Fitness, Inc., its franchisees, all of their owners, employees, agents, successors and assigns to the fullest extent permitted by law for any claim brought by my minor child against them. I also promise to pay any financial obligation incurred by my minor child for any reason and acknowledge that the banking information on this Agreement is my account. I understand that any child of mine under the age of 16 must be accompanied by an adult at all times while in a Snap Fitness® Club.
CLUB USAGE TERMS AND CONDITIONS
DEFINITIONS. In this Agreement, "Club Owner" means Freedom Fitness and Health, LLC, an independent franchisee of Snap Fitness, Inc. "Club" means Snap Fitness Duluth. "I" means the person whose name and signature appear on this Agreement.
USE OF CLUBS. I agree that my use of any Snap Fitness® club is subject to the terms of this agreement and any membership agreement I sign at the club. I will not allow anyone to use the door access card assigned to me. I will not allow someone into the club who does not 1) have an active SNAP Membership, 2) does not swipe their door card.
GUESTS and VISITORS.
SNAP Fitness Duluth members may bring an occasional guest. All guests must fill out the Guest Waiver prior to visiting the club. Allowing entry of a guest into the club without a waiver filled out for each visit will result in an unauthorized guest fee of $30 per violation and possible membership termination. The club may deny access to guests for any reason. I understand and agree that I will be responsible for any claims, damages and charges made by or caused by an unauthorized guest I allow in any Snap Fitness® club.
* ALL members must SWIPE their door card with EVERY VISIT.
* If you visit the club with other SNAP members, EVERYONE must swipe the door card ASSIGNED to them when entering the club. Failure to do so may result in an unauthorized guest charge.
* Allowing others to use the door card assigned to you may result in termination of your membership.
PERSONAL E-MAIL ADDRESS.
I understand that I must provide a valid e-mail address to access and manage my member account online. I also will receive occasional emails from Snap Fitness or the Club related to my membership. I may opt-out from receiving marketing e-mails, but not emails related to my membership, through the "Unsubscribe" link included on such e-mails. I agree that Snap Fitness and the Club may use my e-mail address and other personal information as stated in the Privacy Policy available on the Snap Fitness website.
PHYSICAL CONDITION AND NO MEDICAL ADVICE.
I represent that I am in good physical condition and have no medical reason or impairment that might prevent me from my intended use of Snap Fitness® facilities. I understand and acknowledge that Club Owner and Snap Fitness, Inc. will not and cannot provide me any medical advice. If I have any health or medical concerns now or after I join, I will discuss them with my doctor before using the facilities.
RULES AND REGULATIONS.
I agree to follow any club rules posted at the club or communicated by club staff. Snap Fitness or the Club may, in its sole discretion, modify its rules or policies without notice at any time. Club rules may vary by location. The Club and Snap Fitness reserve the right to refund the pro-rated cost of unexpired services and terminate this membership immediately for any reason or no reason whatsoever.

** SNAP Fitness Duluth has a ZERO tolerance policy for disruptive or unacceptable behavior including but not limited to: threatening, aggressive, harassing, gawking, disruptive, loitering, lude, harmful to the club reputation.
The Club and Snap Fitness reserve the right to terminate any membership immediately for any reason or no reason whatsoever. Failure to follow these rules may result in being asked to leave the facility and possible immediate termination of membership.
DAMAGED, LOST OR STOLEN PROPERTY.
I understand that Club Owner and Snap Fitness, Inc. are not responsible for any of my personal property that is damaged, lost or stolen while in or around any Snap Fitness® location. I understand and agree that I am liable for all damage I cause to the equipment or physical infrastructure of the club facility and will reimburse Club Owner for any damage I cause.
VIDEO & AUDIO NOTICE.
I may not take unauthorized photos or videos anywhere in the Club. I understand that the Club uses unmonitored video and audio surveillance along with logged access card usage. All data is retained by the Club for future use.

Membership Terms & Conditions
DEFINTIONS.
In this Agreement, "Club Owner" means Freedom Fitness and Health LLC, an independent franchisee of Snap Fitness, Inc. "Club" means Snap Fitness Duluth. "I" and "Member" means the person whose name and signature appear on this document.
I authorize you to pay drafts on my behalf to Club Owner (or its designee) in the amount of [price], plus applicable tax, beginning the date this agreement is signed. These payments will continue until I request membership cancellation. I agree that you will be fully protected in honoring these drafts and that your treatment of them and rights in respect to them are the same as if personally signed by me. I understand that I must notify the Club of account changes at least three days before my next billing cycle, and that I may incur an additional fee whenever my payment declines.
MEMBERS' RIGHT TO CANCEL
If you wish to cancel this contract, you may cancel in-person during staffed hours, text the club at 218-212-5213 or use the "termination election" option provided on the club's website and as described in Minnesota Statutes, section 325G.60. The notice must be provided to the club before midnight of the third business day after you sign this contract. If you cancel, the club will return, within ten days of the date on which you give notice of cancellation, any payments you have made. No refunds will be granted after the initial three day period.
MEMBERS' RIGHT TO UNILATERAL TERMINATION
The primary member may request to remove a member on the account or cancel the entire membership at any time by submitting the SNAP Fitness Duluth Membership Change form; available on our website or in person during staffed hours. Non-use of the club does not imply a membership cancellation request.
You may unilaterally terminate this contract in your exclusive discretion at any time. If you terminate, your membership will terminate at the end of the membership term in which you provided the club with notice of termination. If your membership is at-will without a defined membership term, then your membership will terminate immediately, unless you indicate a future effective date of termination. If you wish to terminate this contract, you may terminate in-person or online through the "termination election" provided on the club's website and as described in Minnesota Statutes, section 325G.60, or in any other manner or medium by which you initially accepted membership to the club. The club may not impose a termination fee or any other liability on you for termination.
MEMBERSHIP PAUSE (hold).
I have the right to pause my membership for up to 3 months per calendar Year. During this time, I will not be charged standard monthly dues. I may request to pause (hold) my membership at any time by filling out the SNAP Duluth Membership Change form; available online or in person during staffed hours. I must submit the membership change form to request a membership pause 3 days of my next billing date to pause my membership for the following month to take effect.
Putting membership on hold is not the same as cancelling a membership. Payments will automatically resume at the end of the hold period. A membership on hold may be reactivated at any time by texting SNAP Lakeside at 218-212-5213, duluth@snapfitness.com or visiting during staffed hours.
NOTICE INFORMATION
To provide notice of cancellation or notice of termination to the club: you may use the SNAP Duluth Membership Change form available on the club’s website as well as in-person during staffed hours. You may text us at 218-212-5213 or email duluth@snapfitness.com and we will send you the link directly.
CLUB ENHANCEMENT CHARGE.
Upon signing this agreement, I acknowledge and understand the primary member will be charged an annual Club Enhancement Charge, up to $35 plus tax, once a year; typically, in April. There will be only one charge per membership. The Club has the right to move the Club Enhancement Charge to another month of the year, as long as the charge does not fall within 12-months of the previous charge. The Club has the right to spread the club Enhancement charge into monthly, incremental charges, not to begin within 12 months of the last annual club enhancement charge. This charge will be billed separately from monthly dues. A 30-day notice of the annual charge, along with the option and instructions to opt out, will be posted in the Club, as well as sent to all active members as an email newsletter.
INSURANCE & 3rd PARTY MEMBERSHIPS
Any SNAP Fitness Duluth Membership, paid by a third party, that is not used for any 30-day period may deactivated and the member billed for the membership the enrolled in. There may be a $20 (plus tax) membership deposit to enroll using a 3rd party program. Any door card or membership deposit will be forfeited if the member does not visit a minimum of one time during any month. The Club has the right to deactivate the membership at any time. SNAP Fitness Duluth participation in any 3rd party or insurance-based program may be discontinued at any time and the membership deactivated.
If enrolled through a qualified insurance reimbursement program I acknowledge I have read and signed the Insurance-Reimbursement Member Agreement Form. I understand that for the club to be reimbursed for my membership, I must visit the club at least once per calendar month. If I do not visit in a given month, I authorize SNAP Fitness Duluth to bill my payment method on file for monthly membership dues. After three months of inactivity, my membership will be automatically terminated, and I will no longer be billed for membership dues.
To cancel or pause my insurance-reimbursement membership, I understand that I need to notify SNAP Fitness Duluth within 3 days of the end of the month so I will not be charged membership dues. I may pause my membership for up to 4 months per year at no charge. I understand that if my insurance changes and/or I become ineligible under the insurance wellness program, I will notify the gym to update my insurance information to keep my membership status active or cancel the membership.
RECIPROCITY AND TRANSFER.
Membership to the Club allows me to access other Snap Fitness® locations free of charge. My use of all Snap Fitness® locations is subject to the terms of this Agreement and I have the same obligations to any Snap Fitness® location as I have to the Club and Club Owner, including the assumption of risk and waiver of claims. I understand that if I use another Snap Fitness® location more than the Club, my membership will be transferred to that location according to the then-current membership transfer policy. If my membership is transferred, I agree that this Agreement will automatically be transferred to and enforceable by the new home club and my monthly dues will be the price of the new home club.

MONEY BACK GUARANTEE.
If I do not feel a positive difference in my physical wellbeing within 30 days of signing this Agreement, the Club will give me my money back (membership dues and access card monies). I must do the following two things - (1) work out at the Club twice per week for four weeks AND (2) attend a fitness evaluation with Club staff. To request a refund, I must send or deliver a written notice to the Club on or before the 30th day of my membership including a statement of why I am requesting a refund. The refund does not apply to program fees, tanning, personal training, vending or merchandise purchases.
FACILITIES AND SERVICES.
The Club reserves the right at any time to delete, discontinue, repair or replace the facility equipment without any effect on this Agreement. The Club may be closed for up to two weeks each year for maintenance purposes.
NO STEROIDS or DRUGS.
I understand that the Club bans the use of steroids, and I agree not to use, sell or exchange any kind of steroids or drugs on the Club's premises.
LIMITATION OF LIABILITY.
I agree that, unless controlling legal authority requires otherwise, any award by an arbitrator or a court is limited to actual compensatory damages. I agree that, specifically, neither an arbitrator or a court can award either party any indirect, special, incidental or consequential damages, even if one party told the other party that they might suffer these. SNAP Fitness Duluth is in no way responsible for the actions of others; members or non-members, in or around the club premises. The Club and SNAP Fitness Duluth are in no way responsible for the actions of others, members or non-members, in or around the club premises.
MISCELLANEOUS.
With respect to the Membership Terms and Conditions, this is the whole Agreement between the parties and supersedes any prior understandings or agreements of the parties whether written or oral, express or implied. This Agreement may not be amended or modified except in a writing signed by both parties. I understand that only authorized members or guests may access the Club and I am not permitted to share my access card with anyone else.
