SNAP FITNESS® 2024 Consistency is key SWEEPSTAKES

NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING A PRIZE. VOID WHERE PROHIBITED.

ELIGIBILITY: The Snap Fitness 2024 Consistency is Key Sweepstakes (the “Sweepstakes”) is open only to legal US and Canada residents (except Rhode Island, Puerto Rico, and US territories and possessions) who are at least 18 years of age or older as of the first day of the Sweepstakes. Void where prohibited or otherwise restricted by law. Employees, officers and directors of Sponsor, Sponsor’s franchisees, and their respective affiliated companies, parents and subsidiaries, and the advertising and promotion agencies of each (collectively, the “Sweepstakes Entities”), and their immediate families (defined as spouse, mother, father, sisters, brothers, sons and daughters, regardless of where they reside) and members of their households (whether related or not), and the members of Snap Fitness Clubs where the Snap Fitness Club has opted-out of participating in the Sweepstakes are ineligible to participate in this Sweepstakes. Participation in the Sweepstakes constitutes each entrant’s or their parent’s/legal guardian’s, as applicable, full and unconditional agreement to and acceptance of these Official Rules, including, but not limited to, entrant’s consent to receive e-mail messages from Sponsor solely in connection with the Sweepstakes. Each Sweepstakes entrant is referred to herein as a “Participant” or “you.” All Participants must have reached the age of 18 in his/her state of residence and meet all qualifications outlined in these Official Rules.

HOW TO ENTER: There are two ways to enter the Sweepstakes:

(1) Participants will be automatically entered when they complete all of the following on or prior to March 2, 2024: (1) hold an active Snap Fitness club membership; (2) download the Snap App mobile application (the “Snap App”) and register for a Snap App account (if Participant has not done so already) using the name, email and home club that Participant is a member of; (3) register your Snap Fitness club access card under the Snap App; (4) opt-in to the Sweepstakes via the Snap App; and (5) Participant earning at least 4,000 points in accordance with the “Points” section below; or

(2) Participants may enter without purchase of any kind by mailing a 3” x 5” postcard with your name, address, e-email address (if you have one) and phone number to 2411 Galpin Court, Suite 110, Chanhassen, MN 55317, Attn: Marketing/2024 Consistency is Key Sweepstakes. All entries must be received by March 2, 2024. The Entry Period begins at 12:01 am CST on February 4, 2024 and ends at 11:59 CST on March 2, 2024 (the “Entry Deadline”). Sponsor’s computer is the official clock for the Sweepstakes. All entries must meet the standards set out in these Official Rules. Limit one entry per person.

POINTS: Points are earned as follows:

Week of 2/4/24 – 2/10/24:

o Participant will earn 333 points for every successful scan of their own access card at participating Snap Fitness clubs during this time period.*

o Participant will earn one (1) point for each “Healthy Habits” article read in its entirety (by Participant via the Snap App and under Participant’s Snap App account) for up to a maximum of three (3) points each week during the Sweepstakes. Participant must acknowledge that they read each article via a checkbox found on each article’s landing page to receive the applicable point.

Week of 2/11/24 – 2/17/24:

o Participant will earn 333 points for every successful scan of their own access card at participating Snap Fitness clubs during this time period.*

Week of 2/18/24 – 2/24/24:

o Participant will earn 333 points for every successful scan of their own access card at participating Snap Fitness clubs during this time period.*

Week of 2/25/24 – 3/2/24:

o Participant will earn 333 points for every successful scan of their own access card at participating Snap Fitness clubs during this time period.*

*Each access card scan must be at least six hours following the previous successful access card scan to qualify as a successful scan. Participant must have successfully registered their Snap Fitness club access card under their Snap App account prior to any access card scan for such scan to qualify.

RANDOM DRAWING: The Sponsor will conduct a random drawing on March 4, 2024 in which one winner will be selected out of all eligible entries received.

PRIZES AND APPROXIMATE RETAIL VALUE (“ARV”): One winner will receive the prize noted below. Any prize details not specified below will be determined by the Sponsor in its sole discretion. The prize is not transferable and must be accepted as awarded. No cash or other substitution may be made, except by the Sponsor, who reserves the right to substitute a prize with another prize of equal or greater value if the prize is not available for any reason as determined by the Sponsor in its sole discretion. The winner is responsible for taxes and any other costs and expenses not listed above.

An Apple Watch Series 9 (cellular provider set up and plan rates not included): $499.00 ARV

Winner may be required to sign an Affidavit of Eligibility/Liability and Publicity Release (where legal).

For Canadian Residents Only: Before being declared a winner, the selected entrant must first correctly answer, without assistance of any kind, whether mechanical or otherwise, a time limited mathematical skill testing question to be administered by telephone, e-mail or mail at the Sponsor’s discretion.

If requested, Winner must present state authorized identification prior to being awarded the prize. Winner may be required to present a copy of a valid social security card and valid identification as a condition of participating or receiving any prize when winner will be issued an IRS Form 1099 reflecting the actual value of the prize won.

WINNER NOTIFICATION: The potential winner will be notified via email then telephone. If a potential winner cannot be contacted or fails to respond within 3 days of Sponsor’s first attempt, if the potential winner fails to return the signed Affidavit of Eligibility/Liability and Publicity Release within four (4) days (subject to applicable law), or if a potential winner is deemed ineligible for any other reason, the potential winner will forfeit the applicable prize and an alternate winner will be selected. The Sponsor reserves the right to modify the notification procedures in connection with the selection of an alternate winner, if any.

ODDS OF WINNING: The actual odds of winning will depend upon the number of all eligible entries received.

AGREEMENT TO OFFICIAL RULES: By participating in the Sweepstakes, each entrant fully and unconditionally agrees to and accepts these Official Rules and the decisions of the Sponsor, which are final and binding in all matters related to the Sweepstakes. Each entrants’ participation in the Sweepstakes constitutes permission (except where prohibited by law) to use each winner's name, prize won, hometown and likeness for promotional purposes without further compensation. Winning any prize is contingent on fulfilling all requirements set forth herein.

GENERAL: Sponsor is not responsible for lost, late, incomplete, invalid, illegible or misdirected entries, which will be disqualified; for technical failures of any kind, including, but not limited to, electronic malfunctioning of any network, hardware or software; any failed, incomplete, garbled or delayed computer transmissions or any combination thereof; or for any error, human, technical or otherwise; or any injury or damage to Participant’s or any other person’s computer related to or resulting from entering, participating in, or accessing or downloading information in connection with, this Sweepstakes. Sponsor reserves the right at its sole discretion to modify, cancel or suspend this Sweepstakes for any reason whatsoever including, but not limited to, a computer virus, bug, or other cause beyond the control of Sponsor. Sponsor reserves the right, in its sole discretion, to disqualify any individual it finds tampering with the operation or entry process of the Sweepstakes or acting in violation of these Official Rules or applicable law. Entries submitted after the Entry Deadline will not be accepted.

The Sweepstakes Entities reserve the right to terminate, cancel, suspend and/or modify the Sweepstakes without liability and without prior notice if any factor interferes with its operation as contemplated by these Official Rules, including but not limited to any fraud, virus or other technical problem which corrupts the administration, security, or proper operation of the Sweepstakes. CAUTION; ANY ATTEMPT BY PARTICIPANT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAW. SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.

By participating in the Sweepstakes, Participants agree: (a) to comply with these Official Rules and the decisions of Sponsor which shall be binding and final in all respects; (b) to release Sponsor and its affiliates from all liability, loss or damage arising out of participation in the Sweepstakes or in connection with the awarding, receipt, possession, use and/or misuse of any prize; (c) to be contacted by Sponsor by mail, telephone and/or email; and (d) that they acknowledge that Sponsor makes no warranty, representation, or guarantee, expressed or implied, in fact or in law, relative to any prize, and disclaim all liability for the provision, quality or nature of any third-party products or services provided to the winners.

Except in the cases of death or personal injury caused directly by the intentional misconduct or gross negligence of the Sweepstakes Entities, the Sweepstakes Entities shall have no liability and shall be released and held harmless by Participant(s) and their parent/legal guardian, as applicable, for any damage, loss or liability to person or property, including without limitation any claim for infringement of intellectual property rights, as a result of participation in the Sweepstakes. All prizes are awarded upon the condition that the Sweepstakes Entities shall have no liability whatsoever, subject to the limitations set forth herein, and shall be held harmless for any injuries, losses, or damages of any kind to persons or property, including death, sustained, in whole or in part, directly or indirectly, in connection with or resulting from acceptance, possession or use/misuse of any prize, or participation in the Sweepstakes and any Sweepstakes related activities. Any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes, or any prize awarded, shall be resolved individually, without resort to any form of class action, and exclusively by arbitration (where legal). Claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes, but in no event attorney’s fees.

Except where prohibited, all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the participant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of Minnesota without giving effect to any choice of law or conflict of law rules (whether of the State of MN or any other jurisdiction). Should any provision of these Official Rules be deemed unenforceable or invalid, the other provisions of these Official Rules shall remain in full force and effect.

Sponsor will be collecting personal data about entrants in accordance with its privacy policy. Please review the Sponsor’s privacy policy at https://www.snapfitness.com/us/privacy-policy. By participating in the Sweepstakes, you hereby agree to the Sponsor’s collection and usage of your personal information and acknowledge that you have read and accepted Sponsor’s privacy policy.

Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

Apple is not a participant in or sponsor of the Sweepstakes.
