NO PURCHASE OF ANY KIND IS NECESSARY TO ENTER OR WIN. MAKING A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED BY LAW.
WHO MAY ENTER: This Sweepstakes is open to legal residents of the 50 United States and the District of Columbia (except rhode island) and Canada (except quebec) who are have reached the age of majority in their place of residence. you may not participate if you are not a legal U.S. or Canadian resident and physically located within the U.S. or Canada at the time of entry. Employees, directors and officers and their immediate families (spouses and siblings, parents and children and their spouses) and household members of Snap Fitness, Inc. (“Sponsor”), its franchisees, affiliates and subsidiaries are not eligible. The Sweepstakes is void in Rhode Island, Quebec and where prohibited or restricted by law.
HOW TO ENTER: You may enter by: (1) visiting a Snap Fitness club and leaving your contact information, (2) requesting a free week pass from a Snap Fitness club through the Snap Fitness website at www.snapfitness.com, or (3) if an existing member, by referring a friend at your local club or on mysnapfitness.com à invite a friend. Automated entries (including but not limited to entries submitted using any robot, script, macro or other automated service) are not permitted. Alternatively, you may mail a 3” x 5” postcard with your name, address, e-mail address (if you have one), and phone number to 2411 Galpin Court, Suite 100, Chanhassen, MN 55317, Attn: Marketing/Fitness Makeover. All entries must be received by 5/15/2010.
AGREEMENT TO OFFICIAL RULES: By participating in the Sweepstakes, each entrant fully and unconditionally agrees to and accepts these Official Rules and the decisions of the Sponsor, which are final and binding in all matters related to the Sweepstakes. Winning any prize is contingent on fulfilling all requirements set forth herein.
ODDS OF WINNING: The actual odds of winning will depend on the actual number of entries received for this Sweepstakes.
RANDOM DRAWING: Two winners will be selected at random on or about 5/15/2010 from all eligible entries received. The potential winners will be notified by e-mail (or by mail if entered by mail and no e-mail address is provided). If a prize is refused, a prize notification is returned or deemed undeliverable, or the potential winner is disqualified for any reason, an alternate winner will be selected via a random drawing.
PRIZES: The winners will receive eight (8) one-hour personal training sessions at a Snap Fitness® club. The retail value of each prize is approximately $400. The winner will select their Snap Fitness® club of choice and contact the club to schedule the personal training sessions (some exclusions may apply). Winners may be required to sign a waiver and/or personal training agreement at the club. Personal training sessions must be used by August 15, 2010. Prizes are non-transferrable, with no cash redemption or equivalent. All federal, state, provincial, territorial and local income taxes connected to the prize are the sole responsibility of the winner. Sponsor shall only be responsible for awarding the number of prizes as stated in these rules. Sponsor expressly disclaims any responsibility or liability for injury or loss to any person or property relating to the use of prizes awarded.
CLAIMING PRIZE: As a condition of winning the prizes, the winner must complete, sign and return an affidavit of eligibility and release within fifteen (15) days of receipt of written prize notification or prizes will be forfeited and an alternate winner selected. Further, by accepting the prize, winner consents to Sponsor’s use of their name, photograph and/or likeness, address, voice and statements made by or attributed to them, in perpetuity, in any and all media now known or hereafter developed (including without limitation print, broadcast and internet), for all legitimate business purposes including advertising and promotional activities without additional compensation, unless prohibited by law. If the value of the prize is $600.00 or greater (as determined in Sponsor’s sole discretion), the winner (if a U.S. resident) will be required to provide his or her social security number for tax reporting purposes and Sponsor will file an IRS Form 1099 with the Internal Revenue Service for the prize.
If any correspondence of the sweepstakes judge or any prize is returned as undeliverable, the corresponding prize will be forfeited and will be awarded to an alternate winner. Should a winner make any false statements(s) in any document referenced above, the winner will be required to promptly return to Sponsor his/her prize. Any unclaimed prizes will be awarded in a random drawing to be held as necessary. In the event there is a dispute of the entrant’s identity, the prize will be awarded to the entry will be declared made by the authorized account holder of the email account associated with the entry. The authorized account holder is the natural person who is assigned an email address by an internet access provider, online service provider or other organization (e.g., business, educational, institution, etc.) responsible for assigning e-mail addresses or the domain associated with the submitted e-mail address. Any potential winner may be requested to provide Sponsor proof that such winner is the authorized account holder of the email address associated with the winning entry.
For Canadian Residents Only: Before being declared a winner, the selected entrant must first correctly answer, without assistance of any kind, whether mechanical or otherwise, a time limited mathematical skill testing question to be administered by telephone, e-mail or mail at the Sponsor’s discretion.
PRIVACY: Sponsor will be collecting personal data about entrants in accordance with its privacy policy. Please review the Sponsor’s privacy policy at www.snapfitness.com. By participating in the Sweepstakes, you hereby agree to the Sponsor’s collection and usage of your personal information and acknowledge that you have read and accepted Sponsor’s privacy policy.
LIMITATION OF LIABILITY: By participating in this Sweepstakes, entrants agree to release, hold harmless, and agree not to institute any claim against Sponsor and all co-sponsors of the Sweepstakes and each of their respective parent companies, affiliates, subsidiaries and their respective officers, directors, employees, agents, franchisees and representatives (collectively, “Released Parties”) from any and all liability whatsoever for any injuries, losses or damages of any kind arising from or in connection with, either directly or indirectly, (1) the awarding, acceptance, receipt, possession and/or misuse of any prize awarded herein; and/or (2) participation in the Sweepstakes or any prize related activities, including but not limited to traveling to or from any prize related activity.
Released parties are not responsible for technical, software, telephone or other communication malfunctions, errors or failures of any kind, lost or unavailable network connections, website, internet or ISP availability, unauthorized human intervention, traffic congestion, incomplete or inaccurate capture of entry information (regardless of cause) or failed, incomplete, garbled, jumbled or delayed computer transmissions which may limit one’s ability to enter the Sweepstakes, including injury or damage to your or any other person’s computer relating to or resulting from participating in this Sweepstakes or downloading any materials in this Sweepstakes.
Under no circumstances will entrants be permitted to obtain awards for, and entrants hereby waive all rights to claim, punitive, incidental or consequential damages, or any other damages, including attorneys’ fees, and entrants further waive all rights to have damages multiplied or increased.
MISCELLANEOUS CONDITIONS: If, for any reason, the Sweepstakes is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Sponsor, Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Sweepstakes and select winners from among all eligible entries prior to the cancellation. Persons found tampering with or abusing any aspect of the Sweepstakes, or whom Sponsor believes to be causing malfunction, error disruption or damage will be disqualified. Sponsor reserves the right to correct any typographical, printing, computer programming or operator errors and to substitute any prize for a prize of equal of greater value.
CHOICE OF LAW: All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrants and Sponsor in connection with this Sweepstakes, shall be governed by, and construed in accordance with, the substantive laws of the State of Minnesota, without regard to conflict of law principles.

WINNER: For the name of Sweepstakes winners, mail a stamped self addressed envelope to: 2411 Galpin Court, Suite 110, Chanhassen, MN 55317; Attn: Marketing/Sweepstakes. Requests must be received by 3/1/2010.
